Terms of service
These terms govern your use of quartsmith.com and any order you place with Quartsmith (Quartsmith). By using this site or placing an order, you agree to them. Please read the safety section — it matters more than the rest.
1. Eligibility
You must be at least 18 and able to enter a binding contract. We sell to customers with a delivery address in the United States only.
2. Products, pricing and availability
We do our best to describe and photograph products accurately, though colours and finishes can vary slightly between screens and batches. All prices are in US dollars. We may change prices, withdraw products or correct errors at any time before an order is accepted.
If a product is listed at an obviously incorrect price because of a typographical or system error, we may cancel the order and refund you in full, even after confirmation.
3. Orders
Your order is an offer to buy. A confirmation email acknowledges receipt; the contract is formed when we dispatch the goods. We may refuse or cancel any order, including where we suspect fraud, resale, or an error in pricing or stock, and we refund in full when we do.
4. Payment
Payment is taken at checkout through our payment processor. By submitting payment details you confirm you are authorised to use that payment method.
5. Shipping, risk and title
Delivery is covered by our Shipping Policy. Risk of loss passes to you on delivery to the address you provided. Delivery estimates are estimates and not guarantees.
6. Returns
Returns and refunds are covered by our Return and Refund Policy, which forms part of these terms.
7. Safe use of the product — read this
This is a manual fluid extractor for automotive and small-engine maintenance. It is a tool, and you use it at your own risk.
- Work on a warm engine, never a hot one. Hot oil causes serious burns.
- Park on level ground with the engine off and the parking brake set.
- Follow your vehicle or equipment manufacturer's service instructions and oil capacity. Some manufacturers require draining via the drain plug; check your manual before you extract.
- Do not use with fuel, solvents, acids, or any flammable or corrosive liquid.
- Wear eye protection and gloves. Keep used fluids away from children, pets and drains.
- Dispose of used oil and fluids at an authorised collection point, as required by federal, state and local law. Never pour them down a drain or onto the ground.
Using the product incorrectly can damage your engine or equipment. We are not responsible for mechanical damage, voided manufacturer warranties, environmental penalties, or injury resulting from misuse, from failure to follow these instructions, or from failure to follow your vehicle manufacturer's guidance.
8. Warranty disclaimer
Beyond our 30-day money-back guarantee and any rights you have under applicable law, the products are supplied "as is" and "as available", without warranties of any kind, whether express or implied, including implied warranties of merchantability and fitness for a particular purpose, to the fullest extent permitted by law.
9. Limitation of liability
To the fullest extent permitted by law, our total liability for any claim relating to an order is limited to the amount you paid for that order. We are not liable for indirect, incidental, special or consequential damages, including loss of use, loss of profit, or damage to a vehicle or equipment. Some states do not allow these limitations, so parts of this section may not apply to you.
10. Intellectual property
All content on this site — text, photographs, graphics, layout and the Quartsmith name and logo — belongs to us or our licensors and may not be copied or reused without written permission.
11. Acceptable use
Do not use this site unlawfully, attempt to breach its security, scrape it, or use it to resell our products without our written permission.
12. Indemnity
You agree to indemnify us against claims arising from your breach of these terms or your misuse of a product.
13. Governing law and disputes
Quartsmith operates from Spain. These terms and any dispute arising from them are governed by Spanish law, and the courts of Spain have jurisdiction, except where mandatory consumer protection rules give you the right to bring a claim in the courts of your own place of residence.
Nothing in these terms limits the rights you have under the consumer protection laws that apply where you live, including US federal and state consumer law. Those rights apply in addition to our 30-day money-back guarantee.
14. Changes
We may update these terms. The version in force is the one published on this page when you place your order.
